The new EU Batteries Regulation imposes strict responsibilities and obligations on importers. Its aim is to ensure that batteries and accumulators placed on the market are safe, environmentally friendly, and fully compliant with all requirements of the Regulation.
Below is a summary of the key requirements that every importer must take into account.
Remember! Importers may also be subject to manufacturer responsibilities if they place products on the market under their own name or trademark. Always check whether your company is considered an importer or a manufacturer.
Importer’s responsibilities and obligations
Ensure product conformity before placing on the market
Verify that:
- The EU Declaration of Conformity and required technical documentation have been prepared.
- The conformity assessment procedure has been carried out in accordance with the requirements.
- The battery or accumulator bears the CE marking and other markings required under Article 13 of the Regulation.
- All required documents, instructions, and safety information accompany the product in Finnish and Swedish.
Mark the products with:
- The importer’s name.
- The registered trade name or trademark.
- The postal address of a single point of contact and, where applicable, the website and email address.
Test, monitor, and ensure proper storage and transport
- Test batteries and accumulators on the market as needed to verify conformity.
- Keep records of:
- Customer complaints.
- Detected non-conformities.
- Recall procedures.
- Ensure that storage and transport conditions do not compromise the conformity of the battery or accumulator.
- Take corrective actions if non-conformities are identified:
- Bring the product into conformity.
- Withdraw the product from the market.
- Organize a recall.
- Inform market surveillance authorities about the non-conformity and measures taken.
Retain documentation
- Keep a copy of the EU Declaration of Conformity available to authorities for 10 years from the date the battery or accumulator is placed on the market.
- Ensure that the technical documentation referred to in Annex VIII of the Batteries Regulation is available to authorities upon request.
Cooperate and inform where necessary
- Cooperate closely with distributors and other parties.
- Inform relevant parties about any non-conformities and how they were resolved.
By fulfilling these obligations, you ensure that the batteries and accumulators you import meet EU requirements and that your company operates responsibly and in compliance with the law.
