Manufacturer’s Responsibilities

Under the EU Batteries Regulation, responsibility for the conformity of a battery or accumulator primarily lies with the manufacturer.

All manufacturers and importers must ensure that, going forward, only products compliant with the Batteries Regulation are placed on the market. However, manufacturers have the strictest responsibilities and obligations of all economic operators under the Regulation.

Below is a summary of the key requirements that every manufacturer must take into account.

Remember! In the future, manufacturers must also verify and demonstrate through testing that their products meet the requirements of the Batteries Regulation.

Manufacturer’s responsibilities and obligations

Ensure product conformity before placing on the market

Verify that:

  • The EU Declaration of Conformity and the required technical documentation have been drawn up.
  • The conformity assessment procedure has been carried out in accordance with the requirements.
  • The battery or accumulator bears the CE marking and other markings required under Article 13 of the Regulation.
  • All required documents, instructions and safety information accompany the product, at least in Finnish and Swedish.

Mark the products with:

  • The manufacturer’s name.
  • The registered trade name or trademark.
  • The postal address of the company and, where applicable, its website and email address.

Ensure compliance of storage and transport conditions

  • Storage and transport conditions must not compromise the safety or conformity of the battery or accumulator.
  • Comply with all safety and environmental regulations applicable to batteries and accumulators at all stages of the supply chain.

Test and monitor products on the market

  • Carry out conformity tests on your products to ensure compliance with the Regulation.
  • Keep records of:
    • Customer complaints.
    • Detected non-conformities.
    • Recall procedures.
  • Take corrective actions if non-conformities are identified:
    • Bring the product into conformity.
    • Withdraw the product from the market.
    • Organise a recall.
    • Inform market surveillance authorities of the non-conformity and the measures taken.

Retain documentation

  • Keep a copy of the EU Declaration of Conformity available to authorities for 10 years from the date the product is placed on the market.
  • Ensure that the technical documentation referred to in Annex VIII of the Batteries Regulation is available to authorities upon request.

Cooperate and inform where necessary

  • Cooperate closely with distributors and other parties to ensure conformity throughout the supply chain.
  • Inform relevant parties of any non-conformities and related corrective measures where necessary.

By complying with these obligations, you ensure that the batteries and accumulators you manufacture meet EU requirements and that your company operates responsibly and in accordance with the law.
